defective phone

I started to file a claim with Assurant. But now i'm not sure that's the way to go. Yes i do have a cracked screen but the issue that i'm concerned about is that my phone gets hot even when i'm not using it and it doesn't matter what the battery life is ,it will turn itself off. (i assume it might be a safety precaution,since it gets hot). but then I have to recharge it because it will be dead. And since this started happening the back of the phone is starting to come off (unglued). What should I do ?
